1. Introduction
Welcome to Jumuika ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your access to and use of our website at jumuika.co.ke, our mobile applications for iOS and Android (collectively, the "Platform"), and all related services. By creating an account, accessing, or using the Platform, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you must not use our Platform.
2. Definitions
- "Customer" means a registered user who browses, searches, saves, or inquires about properties.
- "Agent" means a registered real estate professional who lists properties, manages leads, and uses agent tools.
- "Property Listing" means any real estate listing submitted by an Agent, including photos, videos, descriptions, and pricing.
- "Reel" means a short-form video uploaded by an Agent showcasing a property or related content.
- "Credits" means the digital currency purchased by Agents for premium features such as featured listings.
- "Content" means all text, images, videos, data, and other materials uploaded to or generated through the Platform.
3. Eligibility
You must be at least 18 years old to create an account and use the Platform. By registering, you represent that you meet this requirement. Agent accounts are subject to additional verification and approval.
4. Account Registration
You may register as a Customer using email, Google, Facebook, or Apple Sign-In. Agents must apply through the agent registration process and are subject to approval. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You agree to provide accurate, current, and complete information during registration and to keep your profile updated. We reserve the right to suspend or terminate accounts with inaccurate or fraudulent information.
4.5 Age Requirement
You must be at least 18 years of age to create an account on Jumuika. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. Real estate transactions in Kenya require adult legal capacity, and our platform is not intended for use by minors.
4.6 Account Verification
To enhance security and trust on our platform:
- Email Verification: You must verify your email address by entering a verification code sent to your registered email. Unverified accounts may have limited functionality.
- Phone Verification: You may be asked to verify your phone number via SMS code. Verified phone numbers help agents contact you regarding property inquiries.
- Agent Verification: Agent accounts may require additional verification including proof of real estate license, business registration, and professional credentials.
- Two-Factor Authentication: Agent accounts may enable two-factor authentication (TOTP) for enhanced security. We strongly recommend this for all agent accounts.
5. Mobile Application License
We grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the Jumuika mobile application on your personal device for personal, non-commercial use (Customers) or professional real estate activities (Agents). You may not:
- Copy, modify, or distribute the application
- Reverse-engineer, decompile, or disassemble the application
- Remove any copyright or proprietary notices
- Use the application to build a competing product or service
- Use automated systems (bots, scrapers) to access the Platform
5.2 Mobile Application Data Practices
By installing and using our mobile application, you acknowledge and agree that:
- The app stores certain data locally on your device, including your search history, recently viewed properties, favorites, preferences, and authentication tokens. This data can be cleared by clearing the app data in your device settings.
- The app generates a unique device identifier (UUID) for analytics purposes. This identifier is not linked to your personal identity unless you create an account.
- The app communicates with our servers to load property listings, process inquiries, and deliver notifications. An active internet connection is required for core functionality.
- Certain features require device permissions (camera, notifications) which you may grant or deny. Denying permissions may limit specific features but will not prevent you from using core browsing functionality.
- The app integrates third-party services (Google, Facebook, Firebase) whose own terms of service and privacy policies apply to your use of those services.
- The app may periodically check for updates and prompt you to install the latest version for security and functionality improvements.
5.3 Open Source Licenses
Our mobile application uses open-source software components. Licenses for these components are available within the app under Settings > Open Source Licenses.
6. Agent Terms
6.1 Property Listings
Agents are solely responsible for the accuracy, completeness, and legality of their property listings. All listings are subject to review and must comply with our Community Guidelines. We reserve the right to reject, modify, or remove listings that violate our policies.
6.2 Subscription & Credits
Agent subscriptions provide access to tiered features. Credits may be purchased to feature listings or access premium tools. Subscription fees are billed on a recurring basis. Credits do not expire but are non-refundable and non-transferable.
6.3 Lead Management
Leads generated through the Platform are delivered to the listing Agent. Agents must respond to leads professionally and in a timely manner. Failure to respond to leads may result in account restrictions.
7. Customer Terms
Customers may browse listings, save favourites, set property alerts, make inquiries, and book project units. Property inquiries are delivered to the listing Agent; Jumuika does not guarantee agent response times. Jumuika does not act as a real estate broker, agent, or intermediary in any transaction.
8. Payments & M-Pesa
Payments on the Platform are processed through M-Pesa (Safaricom) and bank transfer. By initiating a payment, you authorise us to charge the specified amount through M-Pesa STK Push or C2B PayBill. All payment amounts are in Kenya Shillings (KES). Transaction records are maintained for financial reporting and dispute resolution.
Refunds, if applicable, will be processed within 14 business days to your original payment method. Chargebacks or payment disputes should be raised within 30 days of the transaction.
8.6 Wallet and Credits (Agent Accounts)
- Agents can top up their wallet balance using M-Pesa or bank transfer.
- Credits can be purchased using wallet balance for premium features including property featuring, priority placement, and enhanced listing visibility.
- Credits do not expire but are non-refundable and non-transferable.
- Upon account deletion, any remaining wallet balance and unused credits are forfeited. Agents should withdraw available balance before requesting account deletion.
- Subscription plans auto-renew unless cancelled. Agents can manage subscriptions through their dashboard or by contacting support.
9. User-Generated Content
By uploading Content to the Platform (property listings, reels, photos, reviews), you grant Jumuika a worldwide, royalty-free, non-exclusive licence to use, display, reproduce, and distribute that Content in connection with operating and promoting the Platform. You retain ownership of your Content but are responsible for ensuring you have the necessary rights to upload it.
10. AI-Generated Content
The Platform offers AI-powered tools including property description generation, content suggestions, and the Juma AI assistant. AI-generated content is provided as a starting point and may contain inaccuracies. Agents are responsible for reviewing and editing AI-generated content before publishing. Jumuika makes no warranties regarding the accuracy of AI outputs.
11. Push Notifications & Communications
11.1 Types of Communications
By using our platform, you may receive communications through the following channels:
- Push Notifications (Mobile App):
- Lead notifications: When a customer inquires about your property (Agents)
- Inquiry responses: When an agent responds to your inquiry (Customers)
- Property updates: Price changes, status updates for properties you follow
- Transaction alerts: Payment confirmations, subscription renewals
- Security alerts: Login attempts, password changes, 2FA codes
- Promotional notifications: New listings, featured properties, special offers
- Email: Account verification, password reset, transaction receipts, marketing (with consent)
- SMS (via Africa's Talking): Phone verification codes, critical account alerts
- WhatsApp (via Meta WhatsApp Cloud API): Property updates, agent communications (where opted in)
11.2 Managing Communications
- Push Notifications: Manage in the app under Profile > Settings > Notification Preferences, or via your device Settings > Apps > Jumuika > Notifications
- Email Marketing: Unsubscribe using the link in any marketing email
- SMS: Reply STOP to opt out of non-essential SMS
- WhatsApp: Message STOP to opt out
11.3 Essential Communications
Certain communications cannot be opted out of while maintaining an active account, including security alerts, transaction confirmations, and legal notices. To stop all communications, you must delete your account.
12. Prohibited Activities
You agree not to:
- Post fraudulent, misleading, or inaccurate property listings
- Impersonate another person or misrepresent your identity
- Engage in price manipulation or false advertising
- Harvest or scrape user data or property information
- Interfere with or disrupt the Platform's operation
- Use the Platform for money laundering or any illegal activity
- Share your account credentials with others
- Upload content that infringes intellectual property rights
13. Intellectual Property
All Platform materials, including the Jumuika name, logo, design, software, and proprietary technology, are owned by or licensed to Jumuika and are protected by Kenyan and international intellectual property laws. You may not use our trademarks without prior written consent.
14. Limitation of Liability
Jumuika is a marketplace platform and does not own, manage, or inspect any properties listed. We are not responsible for the accuracy of property listings, the conduct of agents or customers, or the outcome of any property transaction. To the maximum extent permitted by law, Jumuika shall not be liable for any indirect, incidental, consequential, or punitive damages.
15. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free service. Property information, valuations, and market data are for informational purposes only and do not constitute professional advice.
16. Account Suspension & Termination
We may suspend or terminate your account at any time for violation of these Terms or our Community Guidelines. You may delete your account at any time through the app or by contacting us. See our Account & Data Deletion page for details on what happens to your data.
17. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email, push notification, or in-app notice at least 30 days before they take effect. Continued use of the Platform after changes constitutes acceptance.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to arbitration in Nairobi under the Nairobi Centre for International Arbitration rules. You may also file complaints with the Communications Authority of Kenya.
